Terms & conditions

 This Client Agreement outlines the terms, responsibilities, and expectations between The Sleep Clinic (“I”, “we”, “us”, “our”) and the Client (“you”). By signing this agreement, you confirm that you understand and agree to the terms set out below.

 

1. Service Overview

The Sleep Clinic provides one-to-one sleep guidance and educational support for parents and caregivers. All sessions are advisory in nature and are designed to empower you with knowledge, tools, and strategies to help support healthy sleep habits for your child.

 

2. Parental Responsibility & Safe Sleep

You acknowledge and agree that:

- You are solely responsible for the care, health, and safety of your child at all times.

- All recommendations provided by The Sleep Clinic are non-medical, optional, and based on the information you provide.

- You remain responsible for ensuring that all sleep environments and practices meet safe sleep guidelines, including those recommended by The Lullaby Trust UK (https://www.lullabytrust.org.uk).

- The Sleep Clinic cannot be held liable for any incidents, accidents, injuries, or outcomes resulting from unsafe sleep environments, incorrect implementation of advice, or actions taken outside of the consultation sessions.

 

3. Disclaimer & Limitation of Liability

All guidance is for educational purposes and does not constitute medical, diagnostic, or therapeutic advice.

You must seek medical attention for your child if you have any concerns relating to health, development, or wellbeing.

The Sleep Clinic is not liable for:

- any outcomes resulting from incomplete or inaccurate information provided by the client,

- any actions or decisions taken by the client outside of the sessions,

- any sleep practices implemented outside of the safe guidelines referenced above.

 

4. Communication & Session Boundaries

All one-to-one sessions will take place on site at the agreed location.

There is no ongoing support between sessions, unless otherwise agreed in writing by both the client and The Sleep Clinic.

The Sleep Clinic does not offer messaging, email, or phone support outside of booked session times unless explicitly agreed beforehand.

Any additional support outside of session hours may incur additional fees and must be arranged in advance.

 

5. Behaviour and Conduct

The Sleep Clinic is committed to providing a calm, respectful, non-judgmental environment.

You agree that:

- Rude, aggressive, intimidating, or inappropriate behaviour will not be tolerated.

- The Sleep Clinic reserves the right to immediately terminate all future sessions, without reimbursement of fees already paid, if such behaviour occurs.

- Any threatening or abusive conduct may result in the refusal of future services.

 

 6. Payment Terms

The client agrees to pay all fees for services provided by The Sleep Clinic in accordance with the pricing agreed at the time of booking or enrolment. Payment for any services must be made in full and in advance of the relevant session.

Access to support or related services will not commence until payment has been received and cleared by The Sleep Clinic. Where payment is not received by the due date, The Sleep Clinic reserves the right to delay, suspend, or withhold services until payment is made.

Payments must be made using the payment methods specified by The Sleep Clinic. The client is responsible for ensuring that sufficient funds are available and that payment details are kept up to date.

If a payment fails, is declined, or is reversed for any reason, The Sleep Clinic may:

·        suspend support until payment is successfully received

·        terminate the client’s access to services in accordance with these Terms and Conditions.

Unless otherwise stated in writing or required by law, fees paid in advance are non-refundable once the support period has commenced.

The Sleep Clinic reserves the right to review and amend its fees from time to time. Any changes will be communicated to the client in advance and will not apply retrospectively to periods already paid for.

Nothing in this section affects the client’s statutory rights under UK consumer law.

 

7. Cancellations & Refunds

Sessions cancelled with 24 hours’ notice may be rescheduled or refunded for that week at your preference.

Sessions cancelled with less than 24 hours’ notice may not be refunded.

Refunds are not provided for unused sessions, unless due to exceptional circumstances and at our discretion.

 

8. Illness Policy

If a parent, child, the Consultant, or the Consultant’s children are ill, the session may be cancelled and rescheduled. Rescheduled sessions may occur via an online web meeting outside of standard Friday office hours.

 

9. Intellectual Property Rights

All intellectual property rights, including but not limited to copyrights, trademarks, database rights, design rights, trade secrets, and know-how, in any materials provided by or on behalf of The Sleep Clinic (“I”, "we", "us", or "our") remain the exclusive property of The Sleep Clinic or its licensors, in accordance with the Copyright, Designs and Patents Act 1988 and other applicable UK laws. This includes, without limitation, clinical reports, treatment plans, educational materials, written content, graphics, protocols, methodologies, assessments, questionnaires, website content, software, and any other materials provided in physical or digital form ("Clinic Materials").

Clinic Materials are provided solely for the personal, non-commercial use of the client in connection with their assessment, care, and treatment with The Sleep Clinic. The client is granted a limited, non-exclusive, non-transferable, revocable licence to use the Clinic Materials for these purposes only.

Except as expressly permitted in writing by The Sleep Clinic, the client must not:

  • Copy, reproduce, modify, adapt, translate, or create derivative works from the Clinic Materials;

  • Share, distribute, publish, sell, license, rent, or otherwise make the Clinic Materials available to any third party;

  • Use the Clinic Materials for commercial purposes, training, teaching, or professional practice;

  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices.

All trademarks, logos, service marks, and trade names used by The Sleep Clinic are the property of The Sleep Clinic or its licensors and may not be used without prior written consent.

Where the client provides content to The Sleep Clinic (including sleep diaries, questionnaires, digitally-generated sleep data, feedback, or written or verbal communications), the client retains ownership of such content. By providing this content, the client grants The Sleep Clinic a non-exclusive, royalty-free, worldwide licence to use, store, reproduce, and analyse the content for the purposes of:

  • providing clinical and administrative services;

  • monitoring outcomes and improving service quality;

  • training and internal audit;

  • complying with legal and regulatory obligations.

 

10. Consumer Rights Act (UK)

The Sleep Clinic provides all services in accordance with the Consumer Rights Act 2015. This means:

- Services will be delivered with reasonable care and skill.

- Services will be provided as described and agreed.

If The Sleep Clinic is unable to provide a service as agreed due to circumstances within our control, you may be entitled to a remedy, such as a rescheduled appointment or refund.

Nothing in this agreement affects your statutory rights under UK consumer law.

 

11. Data Protection & Confidentiality

Any information you provide is kept confidential and handled in compliance with UK data protection laws.

Client details will never be shared with third parties unless legally required or explicitly agreed by you.
